Participation Agreement

This TREND Community Participation agreement is a legal document between you and TREND Community PBC (“TREND”). It begins on the date you click “I Agree” as part of the onboarding process on Discord. This agreement has details about community rules that you agree to follow.

By participating in the Community, you are saying (1) you have read and understand this agreement; (2) that you are 18 years of age or older; and (3) that you accept this agreement and you’re legally bound by its terms. You must agree to these terms to participate in the Community.

Registration Steps

  • First, you will register with Discord (the technology platform that hosts the Community).
  • Discord’s policies can be found here: https://discord.com/terms
  • You agree to carefully read and honor Discord’s terms and conditions.

Information Use

Any information you provide that identifies you or others can be used by TREND as described in the Privacy Policy. When you participate in the Community, TREND may use automatic means to collect information about your device and about your participation in the Community.

Username and Password Protection

You agree that you’re the only one responsible for making sure any username and password you use for the Community is confidential. You allow TREND and the Community to assume that anyone using your username and password is you or allowed to act for you. You agree to let us know immediately at support@trend.community if you suspect someone is using your account without your permission.

User Content

  • As a Community participant, you’re allowed to submit, upload, publish, or otherwise make available to TREND any text, videos, or images created or gathered by you or others (“User Content”).
  • Any User Content you provide remains your property, or the property of others, as applicable. However, by posting User Content in the Community and sending the User Content to TREND, you’re giving TREND a worldwide, perpetual, irrevocable, transferable, royalty-free license, with the right to use, edit, copy, and distribute such User Content. (In other words if you share it, we can analyze it.)
  • You represent and attest that:
    • (1) you either are the only owner of all User Content or that you have all rights needed to give TREND the license to the User Content as detailed above; and
    • (2) any User Content; your submitting or uploading, User Content; and TREND’s use of the User Content as defined here will not violate a third party’s intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

Community Rules and Guidelines

  • The Community rules and guidelines deal with how you participate in and use the Community. The purpose of the rules and guidelines is to make sure the Community is a safe and comfortable environment for all members.
  • Only members can access the Community.
  • As a Community member, you will respect the rights of the other members to use the Community as it was intended.
  • You agree that you’re the only one responsible for (meaning TREND isn’t responsible for) any violations stated in this document and for any consequences (including loss or damage to TREND) of those violations.
  • You agree that you won’t:
    • Make or encourage/help make unwanted email (“spam”). This activity includes, but is not limited to:
      • imitating or impersonating another person;
      • creating fake accounts to send spam, including those made by “bots”;
      • sending messages to users who have asked not to be contacted;
      • selling, exchanging, or distributing to someone’s contact information to anyone else without that person knowing and giving permission to do so; and
      • using TREND contacts in violation of TREND policy, as determined by TREND.
    • Send, upload, or spread content that is against the law, injures others’ reputation, harassing, abusive, fake, obscene, or otherwise objectionable.
    • Intentionally distribute viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other harmful code or items that are destructive or deceptive.
    • Send or post content that may be harmful to minors under 18 years.
    • Send or post another’s intellectual property or confidential information without the owner’s or licensor’s permission.
    • Send or post anything members post in the Community unless you’re required by law (TREND will let you know). Anything shared in the Community is confidential.
    • Violate others’ legal rights (such as their rights of privacy and publicity).
    • Encourage anyone in the Community to harm herself or himself in any way.
    • Interfere with other people enjoying the Community.
    • Sell, trade, resell or otherwise use for any unauthorized commercial purpose, or transfer, any TREND account.
    • Provide false information.
    • Copy or download any material from the Community unless a Community facilitator says to do so.

Research for Good

The purpose of this research is to better understand patient and caregiver journey, disease burden, disease management strategies, quality of life, and the unmet needs of these communities. Periodically, TREND will analyze the anonymized conversations to generate actionable insights. Additionally, from time-to-time TREND will poll or survey the community members to collect topic-specific insights. This information can then be shared with the community, family members, medical and support teams, pharmaceutical companies, medical device makers, and other stakeholders to improve disease understanding and advance the discovery, development and delivery of treatments that will benefit our communities. Furthermore, our findings can be published online and in peer review journals to fill gaps in the medical and scientific literature.

Other Important Terms

  • TREND doesn’t provide medical advice. Any information in the Community, from TREND or other Community members, is not actual or a substitute medical advice. You should always get medical advice or information about diagnosis and treatment from a doctor or other healthcare professional.
  • Third-party materials. The Community forum may include third-party (i.e., non-TREND) data, information, products, services, and/or materials or provide links to those (“Third-Party Materials”). You acknowledge and agree that TREND isn’t responsible for whether Third-Party Materials are accurate, complete, copyright compliant, legal, or good quality. Third-Party Materials and related links are provided only for your convenience; you access and use them at your own risk and according to the third parties’ terms and conditions.
  • Confidentiality. As a Community member, you may have access to ideas or information that are and should stay confidential. Because of this, any materials or information you access through the Community should be treated as confidential. Please do not share confidential ideas or information with anyone, unless we tell you otherwise or you are required by local law to do so. If confidential information is released, we may have to remove the Community member(s) who released it, or we may have to shut down the Community altogether.
  • Representations and Warranties.
    • You represent and attest that:
        • you’ll follow all laws that apply to your use of the Community;
        • you own or otherwise have and will have the necessary rights and consents in and relating to all content that you or any individual using the Community under your logon credentials submit to the Community so that, as received by TREND and stored and shared within the Community, such content does not and will not infringe, misappropriate, or otherwise violate any intellectual property rights, privacy right, or other rights of any third party or violate any applicable law.
  • Termination. TREND can terminate this agreement at any time without notice if it stops supporting the Community or laws change that affect it, and TREND is the only one who can make this decision. Also, if you violate any of the terms and conditions of this agreement, it will terminate immediately and automatically, and TREND has the right to disable your or anyone’s access to the Community without any notice.

  • Disclaimer of warranties    . The community is provided to you “as is” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, TREND, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the community, including all implied warranties of merchantability or fitness for a particular purpose. Without limitation to what is described above, TREND provides no warranty or undertaking and makes no representation of any kind that the community will meet your requirements.

  • Some jurisdictions don’t allow the exclusion of or limitations on implied warranties or the limitations on the applicable statutory rights of a consumer, so it could be that some or all of the exclusions and limitations mentioned above don’t apply to you.
  • Limitation of liability. To the fullest extent permitted by applicable law, in no event will TREND or its affiliates, or any of its or their respective licensors or service providers, have any liability arising from or related to your use of or inability to use the community, or for any consequential, incidental, indirect, exemplary, special, enhanced, or punitive damages. In no event will provider’s aggregate liability arising out of or related to this agreement under any legal or equitable theory, including breach of contract, tort (including negligence), strict liability, and otherwise exceed the any amounts paid.
  • Applicable law. The laws of the Commonwealth of Pennsylvania will apply to any dispute you might make regarding your use of the Community. If you take any legal action relating to your use of the Community, you agree to file such legal action only in the state or federal courts located in Philadelphia, Pennsylvania and consent to the jurisdiction and venue of such courts.
  • Severability. If any part of this agreement becomes void or invalid because of a law or government order, the remaining parts are still valid and enforceable. The void or invalid provision(s) will be replaced by valid provision(s) that most closely reflect intentions of this agreement.
  • Entire agreement. This agreement, our Privacy Policy, and any other terms you receive while navigating and using the Community represent the entire agreement between you and TREND with respect to the Community, and replace all previous or current understandings and agreements outside this agreement or outside the Community, whether written or oral, regarding the Community.
  • Waiver. No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder. In the event of a conflict between this agreement and any applicable purchase or other terms, the terms of this agreement shall govern.
